EXPLANATORY MEMORANDUM TO THE PROBATE SERVICES (APPROVED BODY) COMPLAINTS REGULATIONS 2004 NO.2951EXPLANATORY MEMORANDUM TO THE PROBATE SERVICES (APPROVED BODY) COMPLAINTS REGULATIONS 2004 2004 No. 2951 1. This explanatory memorandum has been prepared by the Department for Constitutional Affairs and is laid before Parliament by Command of Her Majesty. 2. Description 1. These Regulations relate to the provision of probate services, they prescribe the requirements of a complaints handling scheme, which the person seeking exemption under section 55(2)(d)(ii) of the Courts and Legal Services Act 1990,must be a member of. In addition an Order commences section 53 and section 55 and Schedule 8 and Schedule 9 to the Courts and Legal Services Act 1990. 2. At present the provision of probate services is limited by section 23 of the Solicitors Act 1974. Implementing section 53 and Schedule 8 will allow the Council of Licensed Conveyancers to become an approved body for the provision of probate services in accordance with section 55.
