EXPLANATORY MEMORANDUM TO

THE EDUCATION (PUPIL REFERRAL UNITS) (APPLICATION OF ENACTMENTS) (ENGLAND) (AMENDMENT) (No.2) REGULATIONS 2006

1 This explanatory memorandum has been prepared by the Department for Education and Skills and is laid before Parliament by Command of Her Majesty.

2 Description

2.1 These Regulations amend the Education (Pupil Referral Units) (Application of Enactments) (England) Regulations 2005, which apply to pupil referral units in England. The amendments introduce a number of additional requirements for new staff appointed to pupil referral units from 1 January 2007, as well as the existing requirements around qualifications, health, physical capacity, the absence of any bar from working with children and around being subject to an enhanced Criminal Records Bureau (CRB) check. The additional requirements for staff appointed from 1 January 2007 comprise:

* the person's identity and right to work in the UK must be checked;

* the application for an enhanced CRB check must be accompanied by a children's suitability statement;

* foreign nationals must be subject to an enhanced CRB check, in the same way as all other staff;

* further checks must be carried out on those who have lived overseas if a CRB check is insufficient to establish suitability to ...
