Scottish Statutory Instruments2008 No. 157CLEAN AIRThe Smoke Control Areas (Exempt Fireplaces) (Scotland) Order 2008Made16th April 2008Laid before the Scottish Parliament17th April 2008Coming into force9th May 2008The Scottish Ministers make the following Order in exercise of the powers conferred by section 21 of the Clean Air Act 1993(1) and of all other powers enabling them to do so.In accordance with that section, they are satisfied that the classes of fireplace exempted by this Order can be used for burning fuel other than authorised fuels(2) without producing any smoke or a substantial quantity of smoke.Citation, commencement and extent1.—(1) This Order may be cited as the Smoke Control Areas (Exempt Fireplaces) (Scotland) Order 2008 and comes into force on 9th May 2008.(2) This Order extends to Scotland only.Fireplaces exempted from section 20 of the Clean Air Act 19932. The fireplaces described in the Schedule which comply with the conditions specified in relation to each of them in that Schedule are exempt from the provisions of section 20 (prohibition on emission of smoke in smoke control area) of the Clean Air Act 199...
