  • Farley v Secretary of State for Work and Pensions (No 2); Farley v Child Support Agency
    • Queen's Bench Division (Administrative Court)
    • 12 Jul 2004

Since "the liable person" means "a person who is liable to make payments of child support maintenance" (section 33(1)(a)), how could the magistrates' court be satisfied that child support maintenance has become payable by such a person if it cannot enquire into whether the person against whom the liability order is sought was liable to make the payments in the first place?

Moreover, the argument advanced on behalf of Mr Farley is inconsistent with what one might expect to be the function of the magistrates' court.

  • Secretary of State for Social Security v Harmon; Same v Carter; Same v Cocks
    • Court of Appeal (Civil Division)
    • 05 Jun 1998

The jurisdiction issue raises the question whether the child support officer, the tribunal or the commissioner had jurisdiction to question the validity of the Secretary of State's decision under section 6(1) of the Act to require a parent with care to authorise him to take action under the Act to recover child support maintenance from an absent parent.

  • Huxley v Child Support Offices
    • Court of Appeal (Civil Division)
    • 14 Dic 1999

It is important to bear in mind that the child support scheme is not simply a method for the State to recoup part of its benefit expenditure from the absent parent. The child support system has elements of private and public law but fundamentally it is a nationalised system for assessing and enforcing an obligation which each parent owes primarily to the child. • R (Kehoe) v Secretary of State for Work and Pensions
    • House of Lords
    • 14 Jul 2005

That a caring parent in the position of Mrs Kehoe was given no right of recovering or enforcing a claim to child maintenance against an absent or non-resident parent was not a lacuna or inadvertent omission in the 1991 Act: it was the essence of the new scheme, a deliberate legislative departure from the regime which had previously obtained. The merits of that scheme are not for the House in its judicial capacity to evaluate.
