“
In our view the only proper approach would be to treat, in this respect, the custodial period in the same way whichever sentence is expressed to be consecutive to the other i.e. to treat the final part of the period in custody as the custodial term of the extended sentence. That would be consistent with the concept of aggregation, and can be achieved by the exercise of the Secretary of State's discretion. It equates the approach in both scenarios, and meets the statutory objective.
