Gay Marriage in UK Law

Leading Cases
  • Islington London Borough Council v Ladele (Liberty Intervening)
    • Court of Appeal (Civil Division)
    • 15 December 2009

However, even assuming that argument could be run here, it appears to me that the fact that Ms Ladele's refusal to perform civil partnerships was based on her religious view of marriage could not justify the conclusion that Islington should not be allowed to implement its aim to the full, namely that all registrars should perform civil partnerships as part of its Dignity for All policy.

This appears to me to support the view that Ms Ladele's proper and genuine desire to have her religious views relating to marriage respected should not be permitted to override Islington's concern to ensure that all its registrars manifest equal respect for the homosexual community as for the heterosexual community. This assessment of the assistance to be obtained from article 9 in the present case is reinforced if one looks a little more closely at decisions of the Strasbourg court.

  • McFarlane v Relate Avon Ltd
    • Court of Appeal (Civil Division)
    • 29 April 2010

But the conferment of any legal protection or preference upon a particular substantive moral position on the ground only that it is espoused by the adherents of a particular faith, however long its tradition, however rich its culture, is deeply unprincipled; it imposes compulsory law not to advance the general good on objective grounds, but to give effect to the force of subjective opinion.

So it is that the law must firmly safeguard the right to hold and express religious beliefs. Equally firmly, it must eschew any protection of such a belief's content in the name only of its religious credentials. Both principles are necessary conditions of a free and rational regime.

  • Lee v Ashers Baking Company Ltd and Others
    • Supreme Court
    • 10 October 2018

The Northern Ireland Court of Appeal is a superior court, but the underlying question of construction remains, whether the legislature has by article 61(7) of the 1980 Order, set out in para 62 above, excluded any right of appeal in circumstances such as the present. The finality provision in article 61(7) is therefore focused on the decision on the point of law, not on the regularity of the proceedings leading to it.

  • R Cornerstone (North East) Adoption and Fostering Service Ltd v The Office for Standards in Education, Children's Services and Skills
    • Queen's Bench Division (Administrative Court)
    • 07 July 2020

In considering this issue, I have had full regard to Cornerstone's right to religious freedom. For example, Cornerstone relies on Moscow Branch of the Salvation Army v Russia (2007) 44 EHRR [58]–[61] (‘… the autonomous existence of religious communities is indispensable for pluralism in a democratic society …’).

  • Wilkinson v Kitzinger and Another (Same-sex marriage)
    • Family Division
    • 31 July 2006

I consider that, the nature and extent of the "private interest" and its weight or importance in the overall context should be treated as a flexible element in the court's consideration of the question whether it is fair and just to make the order.
