The Anti-social Behaviour, Crime and Policing Act 2014 (Amendment) Order 2019

Made 18th January 2019

Coming into force in accordance with article 1

The Secretary of State, in exercise of the power conferred by section 5(5)(a) of the Anti-social Behaviour, Crime and Policing Act 20141, makes the following Order.

A draft of this Order has been laid before Parliament and has been approved by a resolution of each House of Parliament in accordance with section 182(2) of that Act.

1. This Order may be cited as the Anti-social Behaviour, Crime and Policing Act 2014 (Amendment) Order 2019 and comes into force on the twenty-first day after the day on which it is made.

2.—(1) The Anti-social Behaviour, Crime and Policing Act 2014 is amended as follows.

(2) In section 5 (applications for injunctions) after subsection (1)(e) insert-

“(ea)

“(ea) Transport for Greater Manchester,”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends section 5 of the Anti-social Behaviour, Crime and Policing Act 2014 (c. 12)to add Transport for Greater Manchester to the list of persons and organisations which can make an application for an injunction under section 1 of that Act. The list already includes Transport for London.

An injunction under section 1 may be granted against a person aged 10 or over if the court is satisfied, on the balance of probabilities, that the person has engaged or threatens to engage in anti-social behaviour and the court considers it just and convenient to grant the injunction for the purpose of preventing the person from engaging in anti-social behaviour.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
