The Road Vehicles (Construction and Use) (Amendment) (No. 6) Regulations 1995

The Secretary of State for Transport, in exercise of the powers conferred by section 41(1), (2) and (5) of the Road Traffic Act 19881, and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:—

Commencement and citation

1. These Regulations may be cited as the Road Vehicles (Construction and Use) (Amendment) (No. 6) Regulations 1995 and shall come into force on 1st January 1996.

2. The Road Vehicles (Construction and Use) Regulations 19862shall be amended in accordance with the following provisions of these Regulations.

3. In the Table in regulation 3(2), in the meaning specified in column 2 for the expression “overall width” specified in column 1—

(a) the word “or” immediately following paragraph (1) shall be omitted; and

(b) after paragraph (m) there shall be added the following—

“; or

(n)

(n) any apparatus fitted to a bus which enables it to be guided wholly or mainly by means of wheels bearing outwards against fixed apparatus, provided that no part of the apparatus projects more than 75mm beyond the side of the bus when the wheels of the bus are parallel to its longitudinal axis;

and the reference in paragraph (n) above to the side of a bus is a reference to the longitudinal plane passing through the extreme lateral projecting points of the vehicle inclusive of all parts of the vehicle, of any receptacle which is of permanent character and accordingly strong enough for repeated use, and any fitting on, or attached to, the vehicle except those items referred to in paragraphs (a) to (n).”.

S-4 Regulation 8 shall be amended as follows. In the Table in...

4.—(1) Regulation 8 shall be amended as follows.

(2) In the Table in paragraph (1), for “2.5” in column 3 of items 3, 4, 5 and 6 there shall be substituted “2.55”.

(3) In paragraph (3), for “2.5” there shall be substituted “2.55”.
