The Multilingual Standard Forms (Consequential Amendments) (Scotland) Regulations 2018

The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 19721and all other powers enabling them to do so.
Citation, commencement and extent
1.—(1) These Regulations may be cited as the Multilingual Standard Forms (Consequential Amendments) (Scotland) Regulations 2018 and come into force on 16 February 2019.
(2) These Regulations extend to Scotland only.
Amendment of the Marriage (Scotland) Act 1977
2.—(1) The Marriage (Scotland) Act 19772is amended in accordance with paragraphs (2) to (4).
(2) In section 3(3) (notice of intention to marry)3, after “shall” insert “, unless subsection (3ZA) applies,”.
(3) After section 3(3) insert—
“3ZA This subsection applies where—
(a) the document submitted is accompanied by a multilingual standard form issued by an authority in a Member State of the European Union in accordance with Regulation (EU) 2016/1191 of the European Parliament and of the Council4; and
(b) the district registrar considers that the information included in the multilingual standard form is sufficient for processing the document.”.
(4) In section 7(1) (marriage outside Scotland where a party resides in Scotland)5, after “sections 3(2), (3)” insert “, (3ZA)”.
Amendment of the Civil Partnership Act 2004
3.—(1) Section 88 of the Civil Partnership Act 2004 (notice of proposed civil partnership)6is amended in accordance with paragraphs (2) and (3).
(2) In subsection (4), after “must” insert “, unless subsection (4A) applies,”.
(3) After subsection (4) insert—
“4A This subsection applies where—
(a) the document submitted is accompanied by a multilingual standard form issued by an authority in a Member State of the European Union in accordance with Regulation (EU) 2016/1191 of the European Parliament and of the Council, and
(b) the district registrar considers that the information included in the multilingual standard form is sufficient for processing the document.”.
