The Air Navigation (Restriction of Flying) (Enniskillen) Regulations 2017

The Secretary of State has decided that it is necessary in the public interest to restrict flying in the vicinity of Enniskillen Airport, County Fermanagh by reason of the intended gathering of a large number of persons at the Harvest 2017 Country Music Festival which is scheduled to take place there.

The Secretary of State makes the following Regulations in exercise of the powers conferred by article 239 of the Air Navigation Order 2016( 1).

Citation and commencement

1. These Regulations may be cited as the Air Navigation (Restriction of Flying) (Enniskillen) Regulations 2017 and come into force on 25th August 2017.

Interpretation

2. In regulation 3(1) the times referred to are Co-ordinated Universal Time( 2).

Restricted airspace

3.—(1) Subject to paragraph (2), between 0700 hours on 25th August and 1100 hours on 29th August 2017, no aircraft is to fly below 3,200 feet above mean sea level within the area bounded by a circle having a radius of 2 nautical miles whose centre is at 542355N 0073907W.

(2) Paragraph (1) does not apply to any aircraft—

(a) operated by or on behalf of the Irish Coast Guard,

(b) operated by or on behalf of the Police Service of Northern Ireland,

(c) operated by or on behalf of the Helicopter Emergency Medical Services, or

(d) flying with the permission of the Enniskillen Airport Air-Ground Service.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations impose restrictions on flying in airspace in the vicinity of Enniskillen Airport, County Fermanagh, by reason of the preparations for, and holding of, the Harvest 2017 Country Music Festival that is scheduled to take place there from 25th to 29th August 2017, inclusive. A large gathering of people will attend this event on each day and the Civil Aviation Authority and the Department for Transport agree that flying should be restricted in the vicinity of the event for reasons of public safety.

In relation to regulation 3, the term ‘aircraft’ includes aircraft as classified in Schedule 4, Part, 1 to the Air Navigation Order 2016 and also includes, by virtue of article 23 of that Order, any small balloon, any kite weighing not more than two kilograms, any...
