The Design Right (Semiconductor Topographies) (Amendment) (EU Exit) Regulations 2018

Coming into force in accordance with regulation 1

The requirements of paragraph 3(2) of Schedule 7 to the European Union (Withdrawal) Act 20181(relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 8(1) of, and paragraph 21(b) of Schedule 7 to, that Act2.

1. These Regulations may be cited as the Design Right (Semiconductor Topographies) (Amendment) (EU Exit) Regulations 2018 and come into force on exit day.

2.—(1) Regulation 4 (qualification) of the Design Right (Semiconductor Topographies) Regulations 19893is amended as follows.

(2) In paragraph (2) for “another” substitute “a”.

(3) In paragraph (4)—

(a)

(a) for “every member State of the European Economic Community” substitute “the United Kingdom”;

(b)

(b) for “any member State” substitute “the United Kingdom”;

(c)

(c) omit from “and subsection (4)” to the end of the sentence.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Design Right (Semiconductor Topographies) Regulations 1989 in order to address failures of those Regulations to operate effectively and other deficiencies (in particular under sections 8(2)(a) and (g)) of the European Union (Withdrawal) Act 2018 (c.16)) arising from the withdrawal of the United Kingdom from the European Union.

An impact assessment has not been published for this instrument as no, or no significant, impact on the private, public and voluntary sectors is foreseen.
