The Registration of Births, Still-Births and Deaths (Prescription of Errors) (Scotland) Regulations 1991

Coming into force 1st July 1991

The Registrar General, in exercise of the powers conferred on him by sections 42(2) and 54(1)(b) of the Registration of Births, Deaths and Marriages (Scotland) Act 19651, and of all other powers enabling him in that behalf, and with the approval of the Secretary of State, hereby makes the following Regulations:

S-1 Citation, commencement and interpretation

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Registration of Births, Still-Births and Deaths (Prescription of Errors) (Scotland) Regulations 1991 and shall come into force on 1st July 1991.

(2) In these Regulations–

“the Act” means the Registration of Births, Deaths and Marriages (Scotland) Act 1965;

“error” includes an error of omission;

“heading” means the unnumbered part or space at the beginning of the form applicable to a register of births, still-births or deaths as set out in Schedules 1, 2 and 10 respectively of the Prescription of Forms Regulations;

“Prescription of Forms Regulations” means the Registration of Births, Still-Births, Deaths and Marriages (Prescription of Forms) (Scotland) Regulations 19652; and

“space No.” means, in relation to the number specified, the part or space of that number in the form applicable to a register of births, still-births or deaths as set out in Schedules 1, 2 and 10 respectively of the Prescription of Forms Regulations.

2. Any error in the particulars of an entry in a register of births, still-births, or deaths which–

(a) falls within a part of the form applicable to the register in question specified in column 1 of the Schedule to these Regulations; and

(b) is of a description specified opposite thereto in column 2 of that Schedule,

is hereby prescribed for the purposes of section 42(2) of the Act as an error which, subject to the proviso thereto, may be corrected thereunder by the district registrar.

Heading

Error in any of the information in the heading.

Space No. 2

Error in the sex, but only where the correct sex is compatible with the name of the child.

(i) Error in the date of birth, but only where the date of birth remains within 3 months of the date of registration;

(ii) Error in the time of birth.

Space No. 4

Error in the place of birth, but only where the place of birth remains within the same registration district.

Error in the mother’s name or surname, but only where the error relates to a part or the whole of either the name or of the surname and not to the identity of the mother.

Error in the mother’s maiden surname.

Error in the mother’s usual residence, but only where the usual residence remains within the same registration district.

Error in the father’s name or surname, but only where the error relates to a part or the whole of either the name or of the surname and not to the identity of the father.

Error in the occupation.

Error in the date or the place of the parents' marriage.

Error in the qualification of the informant.

Error in the date of registration, but only where the correct date is compatible with the date of registration of the previous entry in the register and of any subsequent entry.
