CIVIL DEFENCE
The Civil Defence (Designation of the Minister of Health) Order, 194928thJuly 1949

Whereas by subsection (2) of section nine of the Civil Defence Act, 1948(b), it is enacted that the expression "the designated Minister" in that Act means such Minister as may be designated by Order in Council and that different Ministers may be designated for different purposes or different provisions of the Act:
Now, therefore, His Majesty is pleased, by and with the advice of His Privy Council, to order, and it is hereby ordered, as follows:—
1. Subject to Article 2 of this Order the Minister of Health is designated Minister for the purposes of the Civil Defence Act, 1948, in relation to the matters set out in the Schedule hereto and, in relation to those matters, for all the provisions of the said Act except for—
(i) the provisions of section three of the said Act as to the making of regulations;
(ii) the provisions of section four of the said Act (which confers powers in relation to land);
(iii) the provisions of section five of the said Act relating to members of police forces and fire brigades.
2.—(1) Nothing in this Order shall affect the functions from time to time exercisable by the Secretary of State, by virtue of the said Act or otherwise, in relation to the Civil Defence Corps.
(2) In this Article the expression "Civil Defence Corps" means the Corps established by and under the Warrant of the Secretary of State intituled The Civil Defence Corps Warrant, 1949, and any subsequent Warrants of the Secretary of State amending it and from time to time in force.
3.—(1) This Order may be cited as the Civil Defence (Designation of the Minister of Health) Order, 1949.
(2) This Order shall not apply to Scotland.

The taking of measures to deal with casualties and disease.
The transference of members of the civil population from one area to another and the care of persons so transferred.
The care of persons who owing to hostile action or a threat of hostile action are made homeless or leave their homes or are refugees or persons repatriated from abroad.
The prevention or mitigation of loss or damage to movable property in their homes of persons who are made homeless by hostile action or of persons...
