Ministers of the Crown (Parliamentary Secretaries) Act, 1960

(9 & 10 Eliz. 2) CHAPTER 6

An Act to replace the existing limits on the numbers of Parliamentary Secretaries in individual departments by a single aggregate limit; to authorise the payment of a salary to a Parliamentary Secretary to the Minister for Science; and to increase the salary of the Captain of the Gentlemen-at-Arms.

Be it enacted by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

S-1 Numbers of Parliamentary Secretaries.

1 Numbers of Parliamentary Secretaries.

(1) The limits imposed by section two of the Ministers of the Crown Act, 1937 , or by any other enactment upon the number of persons to whom salaries may be paid as the holders of any one or more of the offices to which this section applies, or who may be appointed to hold any such office, shall cease to have effect; but the total number of persons to whom salaries may be paid at any time as the holders of all such offices shall not exceed thirty-three.

(2) This section applies to the offices listed in Part II of the Second Schedule to the House of Commons Disqualification Act, 1957 , except those of the Law Officers, the Secretaries to and Junior Lords of the Treasury, and the Treasurer, Comptroller and Vice-Chamberlain of Her Majesty's Household.

S-2 Salary of Parliamentary Secretary for Science.

2 Salary of Parliamentary Secretary for Science.

(1) There shall be paid out of moneys provided by Parliament to any person holding office as Parliamentary Secretary to the Minister for Science an annual salary not exceeding two thousand five hundred pounds.

(2) For the purposes of section six of the Ministers of the Crown Act, 1937 (which makes provision against duplicate salaries) any salary payable under this section shall be deemed to be a salary payable under that Act.

(3) The office of Parliamentary Secretary to the Minister for Science shall be included in the list of Ministerial Offices set out in Part II of the Second Schedule to the House of Commons Disqualification Act, 1957.

S-3 Salary of Captain of Gentlemen-at-Arms.

3. The amount of the annual salary payable under section two of the Ministerial Salaries Act, 1946, to the Captain of the Honourable Corps of Gentlemen-at-Arms is hereby increased from two thousand two hundred to three thousand pounds.

S-4 Consequential amendments and repeals.

4 Consequential amendments and repeals.

(1) The enactments described in the first column of the First Schedule to this Act shall have effect subject to the amendments specified in the second column of that Schedule, being amendments consequential on the foregoing provisions of this Act.

(2) The enactments described in the Second Schedule to this Act are hereby repealed to the extent specified in the third column of that Schedule.

S-5 Expenses.

5. There shall be defrayed out of moneys provided by Parliament any increase attributable to the provisions of this Act in the sums authorised to be paid out of moneys so provided under any other enactment.

S-6 Interpretation and short title.

6 Interpretation and short title.

(1) Any reference in this Act to any enactment is a reference thereto as amended by or under any other enactment, including this Act.

(2) This Act may be cited as the Ministers of the Crown (Parliamentary Secretaries) Act, 1960 .

In section five, in subsection (2), for the words from ‘to the secretary’ to ‘servants’ there shall be substituted the words ‘to the secretaries (other than any Parliamentary Secretary) and to the officers and servants’.
