The Traffic Signs (40 m.p.h. Speed Limit) Regulations, 1958

The Secretary of State and the Minister of Transport and Civil Aviation (hereinafter referred to as "the Minister") acting jointly in exercise of their powers under sections 48 and 59 of the Road Traffic Act, 1930(a), as read with the Transfer of Functions (Roads, Bridges and Ferries) Order, 1955(b), section 35 of the Road Traffic Act, 1956(c), and of all other powers them enabling in that behalf hereby make the following Regulations:—

1. These Regulations shall come into operation on the fifteenth day of March, 1958, and may be cited as the Traffic Signs (40 m.p.h. Speed Limit) Regulations, 1958.

2.—(1) In these Regulations the following expressions have the meanings hereby respectively assigned to them:—

"classified road" means a road classified by the Minister under the Ministry of Transport Act, 1919(d), in Class I or Class II;

"forty miles per hour speed limit" means a speed limit of forty miles per hour on the driving of mechanically propelled vehicles imposed under section 10 of the London Traffic Act, 1924(e);

"hours of darkness" means the time between half-an-hour after sunset and half-an-hour before sunrise;

"Schedule" means the Schedule to these Regulations;

"the directions" means the Traffic Signs (40 m.p.h. Speed Limit) Directions, 1958(f).

(2) Any reference in these Regulations to any enactment shall be construed as a reference to that enactment as amended by any subsequent enactment.

(3) The Interpretation Act, 1889(g), shall apply to the interpretation of these Regulations as it applies to the interpretation of an Act of Parliament.

3.—(1) Every traffic sign for conveying to traffic information that a forty miles per hour speed limit is in force on a length of road shall be of the size, colour and type shown in either diagram 1, diagram 2 or diagram 3 in the Schedule.

(2) Every traffic sign for conveying to traffic information as to the point at which a forty miles per hour speed limit ceases to be in force on a length of road shall be of the size, colour and type shown in diagram 4 in the Schedule, notwithstanding that a sign of that size, colour and type is by the Traffic Signs (30 m.p.h. Speed Limit) Regulations, 1957(h), prescribed for conveying information as to the point at which a length of road ceases to be a road which is deemed to be a road in a built-up area.
