Whereas the Minister of Agriculture, Fisheries and Food and the Secretary of State are of the opinion, in accordance with section 1(1)(a) of the Food and Environment Protection Act 1985(a), that there has been or may have been an escape of substances of such descriptions and in such quantities and such circumstances as are likely to create a hazard to human health through human consumption of food;
And whereas the said Ministers are of the opinion, in accordance with section 1(1)(b) of the said Act, that in consequence of the said escape of substances food which is or may be in the future in the area described in article 2 of the following order, or which is derived or may be in the future derived from anything in that area, is, or may be, or may become, unsuitable for human consumption;
Now, therefore, the said Ministers, in exercise of the powers conferred on them by the said section 1(1) and section 24(3) of the said Act, and of all other powers enabling them in that behalf, hereby make the following order:—
Title and commencement
1. This order may be cited as the Food Protection (Emergency Prohibitions) (No. 5) Amendment No. 2 Order 1986 and shall come into operation on 7th August 1986.
Amendment of the principal order
2. The Food Protection (Emergency Prohibitions) (No. 5) Order 1986(b) is revoked to the extent that it describes an area outside the area described in this article; and accordingly for paragraph 1 of the Schedule to that order there shall be substituted the following paragraph—
"Cumbria
1. An area comprising those parts of the county of Cumbria which lie within the following boundary:—
From the junction of the road A593 with the road B5285 at Coniston, south west on the road A593 via Torver and Lower Hawthwaite to its junction
(a) 1985 c.48.
(b) S.I. 1986/1294, amended by S.I. 1986/1344.
with the road A595(T) at Broughton-in-Furness; south west on the road A595(T) via Duddon Bridge to Whicham; north on the road A595(T) via Bootle and Gosforth to its junction with the minor road at Calder Bridge (O.S. map ref. NY 042060); north east on the minor road to its junction with a minor road at O.S. map ref. NY 048065; north on the minor road to its junction with a minor road...
