Whereas the Secretary of State is of the opinion, in accordance with section 1(1)(a) of the Food and Environment Protection Act 1985(a), that there has been or may have been an escape of substances of such descriptions and in such quantities and such circumstances as are likely to create a hazard to human health through human consumption of food;
And whereas he is of the opinion, in accordance with section 1(1)(b) of the said Act, that in consequence of the said escape of substances, food which is, or may be in the future, in the areas described in the first Schedule to the principal order, or which is, or may be in the future, derived from anything in those areas, is, or may be, or may become, unsuitable for human consumption;
Now, therefore, in exercise of the powers conferred on him by the said section 1(1) and section 24(3) of the said Act, and of all other powers enabling him in that behalf, he hereby makes the following order:—
Title, commencement and interpretation
1.—(1) This order may be cited as the Food Protection (Emergency Prohibitions) (No. 7) (Amendment No. 2) Order 1986 and shall come into operation on 29th August 1986.
(2) In this order "the principal order" means the Food Protection (Emergency Prohibitions) (No. 7) Order 1986(b).
Amendment of the principal order
2. The principal order is revoked to the extent that it imposes prohibitions in respect of sheep which are in the areas described in article 3 to this order on 29th August 1986; and accordingly the principal order is further amended in accordance with the following provisions of this order.
(a) 1985 c.48.
(b) S.I. 1986/1422, amended by S.I. 1986/1432.
3. Schedule 2 to the principal order (Area excepted from Articles 4, 5 and 6) is amended as follows:—
(i) After Item 1(b) there shall be added:
"(c) In the District of Nithsdale the parish of Sanquar;
(d) In the District of Stewartry the parish of Balmaclellan.".
(ii) After Item 2 there shall be added:
"On the Island of Arran that part of the parish of Kilmory lying to the north of a line extending from the shore at Cleiteadh Buidhe, on the western side of the Island at Machrie Bay, eastwards across the road A841 and along an unclassified road to its junction...
