Digital assets questionnaire1
The term ‘digital asset’ is the way that the legal community refers to your
personal rights, data and sometimes information, that is kept or stored
electronically. It may not be stored on any one computer but on a
number of computers (known as a network) or remotely through an
online ‘cloud’ server account. These three different storage methods may
belong to you or a third party. These third parties may be the companies
you transact business with (such as a retailer). Anyone who uses email,
makes online purchases, sells an item online, or pays bills online has
some form of digital data and possibly digital asset. Digital assets
generally require a username and/or password or PIN to access and can
be difficult or impossible to retrieve if someone is incapacitated or passes
away. Some digital assets have a monetary value while others have
sentimental value. Either way, they are often very important to the people
who create them, and it is therefore important that should anything
happen to you then your executors or those with powers of attorney
know where to find them. The purpose of this worksheet is for you to
record all your digital assets by category, then keep it in a safe place.
You will need to share where that ‘safe place’ is with your solicitor, those
with powers of attorney, executor, and other trusted people who would
need to have this information. Note that some accounts allow for two-
factor authorisation, so a note needs to be made about which accounts
those are and how to access the second factor (e.g. app on mobile phone
such as Google Authenticator, card in wallet, mobile phone text message
code, etc).
The purpose of this form is to capture information related to your digital
assets and digital habits. The purpose of this form is not to act as a record
of usernames/passwords/PINs.
The answers you provide in this questionnaire will be used to assist your
executors in dealing with your estate on your death. These answers will
