Application for a determination as to liability to
pay an administration charge or for the variation of a fixed administration charge

Schedule 11 to the Commonhold and Leasehold Reform Act 2002 (as amended by section 131 Housing and Planning Act 2016)

It is important that you read the notes below carefully before you complete this form.

This is the correct form to use if you want to ask the Tribunal either

(1) to make an order under paragraph 3 of schedule 11 to the Commonhold and Leasehold Reform Act 2002 varying a fixed administration charge

OR

(2) to make a determination, under paragraph 5 of schedule 11 as to whether an administration charge is payable and if so, the amount payable.

If the Tribunal finds that an administration charge is payable, it can also determine:

  • the person by whom it is payable
  • the person to whom it is payable
  • the amount which is payable
  • the date at or by which it is payable

(See further the Note to section 6 of this form).

A fee is payable for this application (see section 14 for Help with Fees). The fees are set out in this form.

Applications should be sent as a Microsoft Word document by email to the relevant regional tribunal address shown in the Annex to this form. You must also send by email the documents listed in section 14 of this form. If you cannot access email or find someone to assist you in lodging your application by email, then a paper application will be acceptable although there may be a delay in dealing with this. Sending an application on paper will not be suitable in urgent cases.
