Dear Eleanor and Mark
Approval of the 90th supplemental agreement to the track access
contract between Network Rail Infrastructure Limited (Network Rail) and
Arriva Rail London Limited (trading as ‘London Overground’) dated 9
November 2007
We have today approved the above supplemental agreement submitted to us formally on
28 June 2024 under section 22 of the Railways Act 1993 (the Act). This follows an earlier
informal submission of a draft agreement for our consideration. This letter explains the
reasons for our decision.
Purpose
The purpose of this agreement is to convert two existing late-night weekend Empty
Coaching Stock (ECS) movements between Watford Junction and Willesden Junction into
passenger services. This will extend the hours of service at some stations along the
Watford lines and is intended improve the overall service level. The changes are proposed
to commence on the Principal Change Date in December 2024 and will expire at the expiry
date or earlier termination of London Overground’s track access contract.
Industry consultation
Network Rail undertook the usual industry consultation between 16 May and 17 June.
Three responses were received: ‘no objection’ comments from Great Western Railways
and Transport Focus, and a response in support from London TravelWatch.
