The Registrar General, in e xercise of the powers conferred upon him by secti ons 28A(4), 37(2) an d
(3), 38(2) and (3), 40(1), 43(8), 47, 54(1) and 56 of the Registration of Births, Deaths and
Marriages (Scotland) Act 1965(a) and sections 3(1), 25 and 26 of the Marriage (Scotland) Act
1977(b) and of all other powers enabling him in that behalf and with the approval of the Scottish
Ministers, hereby makes t he following Regulation s:
Citation and commencement
1. These Regulations may be cited as the Births, Deaths, Marriages and Divorces (Fees)
(Scotland) Amendment Regulations 2002 and shall come into force on 1st October 2002.
Amendment of the Births, Deaths, Marriages and Divorces (Fees) (Scotland) Regulations
1998
2. The Births, Deaths, Marriages and Divorces (Fees) (Scotland) Regulations 1998(c) are
amended in accordance with the following regulations.
3. In regulation 2(1) (interpre tation), after the definition of “the 1977 Act”, insert–
““bulk particular search” means a search for multiple specified entries, by comparison of
electronic records, caused to be made by the Registrar General;”.
4. In Schedule 1, Part I (searches in statutory registers and parochial registers)–
(a) in the first entry in column 2, omit paragraph (c) (appl ication made by elect ronic mail)
and the corresponding entr ies in columns 3 and 4;
(b) in the second entry in column 2, omit paragraph (c) ( application made by elect ronic
mail) and the corresponding e ntries in columns 3 and 4; and

1985 (c.73); section 54(1) was amended by th e Children Act 1975 (c.72), Sc hedule 4, Part III and by the Marriage
(Scotland) Act 1977 (c.15), Schedu le 3; section 56 contains a definition of “p rescribed” relevant to the exercise of the
statutory powers under which these Regulations are made. The Functions of the Secretary of State under section 54(1)
were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).
(b) 1977 c.15; section 26 contains a definition of “prescribed” relevant to the exercise of th e statutory powers under which
these Regulations are made. The Functions of the Secretary of State under section 25 were transferred to the Scottish
Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).
