The Building (Amendment of Prescribed Fees) Regulations 1992

Coming into force 1st October 1992

The Secretary of State, in exercise of the powers conferred upon him by sections 1, 3, 16(10), 34, 35, 50(3) and 1261of, and paragraphs 2, 5 and 10(c) of Schedule 1 to, the Building Act 19842, and all other powers enabling him in that behalf, hereby makes the following Regulations:

S-1 Citation and commencement

1. These Regulations may be cited as the Building (Amendment of Prescribed Fees) Regulations 1992 and shall come into force on 1st October 1992.

S-2 Amendment of the Building (Prescribed Fees etc.) Regulations 1985

2.—(1) The Building (Prescribed Fees etc.) Regulations 19853are amended in accordance with the following paragraphs of this regulation.

(2) In Schedule 1 (small domestic buildings) there shall be substituted—

(a)

(a) for “£95” in both paragraphs 2 and 5, “£104”, and

(b)

(b) for Tables 1 and 2, the following Tables—

(3) In Schedule 2 (small garages, carports and certain alterations and extensions) there shall be substituted—

(a)

(a) in paragraph 1, for “£15”, “£45” and “£60” respectively, “£16”, “£50” and “£66”, and

(b)

(b) for the Table in paragraph 2, the following Table—

S-3 Transitional Provisions

Transitional Provisions

3. These Regulations shall not affect the application of the Building (Prescribed Fees etc.) Regulations 1985 in relation to work in respect of which—

(a) a building notice was given or full plans were deposited under regulation 11 of the Building Regulations 19854or regulation 11 of the Building Regulations 19915; or

(b) an initial notice or a public body’s notice was given under section 47(1) (giving and acceptance of initial notice) or 54(1) (giving, acceptance and effect of public body’s notice) of the Building Act 1984,

before 1st October 1992, notwithstanding that on or after that date a notice is or hasbeen given, or plans are or have been deposited, in respect of substantially the same work.

S-4 Revocations

Revocations

4. Regulation 2(5)(c) of the Building (Amendment of Prescribed Fees) Regulations 19866, and regulations 3 and 4 of the Building (Amendment of Prescribed Fees) Regulations 19907are hereby revoked.

These Regulations amend the Building (Prescribed Fees etc.) Regulations 1985 so as to increase the fees payable to a local authority by—

(a) approximately 9.4% in respect of the erection of small domestic buildings and connected work (Schedule 1 to the 1985 Regulations), the erection of certain garages, carports (Schedule 2 to those Regulations), and for other types of work not mentioned in either Schedule 1 or 2 (Schedule 3 to those Regulations);

(b) approximately 50% in respect of the making of small extensions and alterations to domestic buildings (Schedule 2 to those Regulations).
