Changing Responses to Juvenile
Arrests: Analyzing 30 Years of
Juvenile Court Records

Abstract
This article assesses change in juvenile formal social control in the United States from 1985 to 2014. By
combining national juvenile arrest and court data, I compute and analyze arrest-adjusted trends in court
processing and case dispositions. Results indicate that the juvenile justice system now operates with a
wider net of control through stronger connections with law enforcement and increased use of less-severe
dispositions, especially those dispensed prior to adjudication. This increased exposure to formal system
involvement, even if less severe, nonetheless raises concerns for youth and their social and developmental
outcomes of system involvement.

Oscillations in juvenile justice philosophy have characterized system operations through-
out its existence. Recent changes over the past several decades have received much schol-
arly attention for their influence on the shift to and away from ‘toughness’ in law and
policy (Bernard and Kurlychek, 2010). Research examining the implementation of this
punitive turn, typically focused on changes in and impacts of the harshest juvenile court
sanctions, indicates growth in the use of secure placement or waiver to adult court through-
out the 1980s and 1990s (e.g. Hockenberry and Puzzanchera, 2020; Merlo and Benekos,
2010; National Research Council, 2013). While they clearly warrant attention due to their
disruptive and intrusive nature, the empirical focus on these severe dispositions has not
been systematically counterbalanced with description of changes in less severe disposi-
tions and case outcomes. Such a comprehensive and contemporaneous analysis changes
of juvenile court interventions across all formal points of institutional contact and severity
is necessary to fully illuminate the evolution of juvenile social control. This foundational
but yet unaccounted for knowledge is important for two reasons. First, any justice system

involvement early in the life course – not limited to placement or waiver – can increase
future delinquency, system involvement, and accumulated social and developmental dis-
advantage into adulthood (Sampson and Laub, 1997). Second, evaluating trends in formal
court actions and dispositions across the full continuum of adjudicatory processing is
necessary for determining if and how policy oscillations affected the amount and nature
of control dispensed through the juvenile system in ways unintended or counterproductive
to the intent of implemented policy reforms (National Research Council, 2001).
To start to fill in this knowledge gap, this article provides a comprehensive description
of the recent evolution of juvenile formal social control by asking: (1) how has the rela-
tionship between juvenile arrest and juvenile punishment changed?; (2) what is the rela-
tive growth in outcomes of system contact spanning the adjudicatory process that range in
severity and intrusiveness?; and (3) what, if anything, do these changes indicate about
aggregate trends in the amount or nature of juvenile formal social control? Using court
data combined with arrest data, I analyze an annual panel (1985–2014) of various forms
of juvenile justice system involvement (case referrals, petitions, and dispositions).
Computed arrest-adjusted changes in court decisions and dispositions allows an assess-
ment of changes in the total amount of interventions dispensed through the juvenile courts
net of changes in the universe of potential cases (arrests), an essential comparison for
evaluating unintended outcomes of policy reforms. Results indicate a net increase in
arrested youths’ referral and petition to the juvenile court and an increased role of less
severe dispositions, like probation and dismissal, to resolve these cases. Because these
increases materialize as arrests decline, they are suggestive of a widened net of control
that is not singularly harsher, but increasingly interventional. The discussion section raises
concerns for the implications of these findings for system policy and, more importantly,
outcomes for system-involved youth at increased risk of correlated adverse social and
developmental consequences from an increasingly interventional system. This article pro-
ceeds by overviewing the literature on the forms and social consequences of juvenile
justice contact to motivate this study, then describes the utilized data and methods, and
concludes with discussion of the implications of results for system policy and system-
involved youth.
The Forms and Consequences of Juvenile Justice System

Separate from adult criminal justice systems, juvenile justice systems respond to delin-
quency allegations for persons under the age of criminal responsibility (18 years old, in
most American states) utilizing a distinct approach, organizational structure, and legal
rationale and in a manner purportedly more appropriate for young people’s developmental
status (Bernard and Kurlychek, 2010). Ideally, sanctions dispensed to court-involved
youth balance competing goals of treatment and control to deliver minimally invasive and
maximally beneficial interventions highly individualized to address youths’ needs (e.g.
Greenwood, 1996). However, varied perspectives identify potentially adverse outcomes
of juvenile justice system involvement, despite these benevolent intentions. Theories con-
tend that earlier timed system contacts can carry long-term consequences for crime and
