Continuing duty to disclose

Once you are aware of the commencement of litigation proceedings, you have an ongoing duty to disclose any material that meets the guidance COG11905.

You should make the case solicitor aware of any additional material that meets the disclosure test. You must also make them aware if the material is sensitive and the reasons for sensitivity. This would also be a good time to tell the Civil Disclosure Unit and the Disclosure Coordination Unit (DCU) if they are not already aware. It is also possible that the relevance of material already in the caseworker’s possession changes after the receipt of further information from the appellant.
