The Civil Defence (Demolition and Repair Services) Regulations, 1950

Whereas by the Civil Defence (Designation of Minister of Health) Order, 1949(a), as varied by the Civil Defence (Designation of Minister of Health) (Amendment) Order, 1950(b), the Minister of Health has been designated the Minister for certain purposes of the Civil Defence Act, 1948(c), including the purpose of making regulations under section 2 thereof in relation to the repair of war damaged premises, the provision of demolition and clearance services and the prevention or mitigation of loss or damage to moveable property in war damaged dwelling-houses:

Now, therefore, the Minister of Health, in exercise of the powers conferred on him by the said section, and of all other powers enabling him in that behalf, hereby makes the following regulations:—

1.—(1) These regulations may be cited as the Civil Defence (Demolition and Repair Services) Regulations, 1950, and shall come into operation on the fourteenth day after the day on which the draft thereof was approved by Parliament.

(2) The Interpretation Act, 1889(d), applies to the interpretation of these regulations as it applies to the interpretation of an Act of Parliament.

(3) In these regulations, the following expressions have the meanings hereby assigned to them—

"local authority" means the council of a county, county borough or county district, the Common Council of the City of London, the council of a metropolitan borough or the council of the Isles of Scilly; and

"the Minister" means the Minister of Health.

2. It shall be the duty of every local authority, at the request and in accordance with the directions of the Minister—

(a) to make plans for setting up an organisation having as its objects—

(i) the execution of urgent repairs to premises which by reason of damage by hostile action become unfit for use, being dwelling houses or premises providing goods or services essential to the life of the community, not being factories, workshops, warehouses or schools;

(ii) the demolition and clearance of property damaged by hostile action;
