What One Might Look
Like and How to Use It
For the probate practitioner there are many challenges when considering
the digital aspects of the client’s estate. One of the most concerning areas
for any practitioner is the risk that the digital assets could be lost. There
are a number of possible actions that could be taken to minimise the risk
of loss of data and information, but the most useful strategy is to capture
information from the client directly in the form of a comprehensive client
questionnaire. This chapter considers how that client questionnaire might
be put together and some of the questions that practitioners may wish
to include.
3.1 The introduction
The opening paragraph should serve to introduce the form and the type
of information requested as well as introducing the purposes of the
questionnaire:
The purpose of this form is to capture information related to
your digital assets and digital habits. The purpose of this
form is not to act as a record of usernames/passwords/PINs.
The answers you provide in this questionnaire will be used
to assist your executors in dealing with your estate on your
death. These answers will also be helpful to your attorney
or deputy in the event that you are incapable of dealing with
your own affairs. It is important to be as detailed as possible
when answering the questions in this questionnaire.
Clients can often misunderstand the purpose of such questionnaires,
particularly if they are overly long or drafted in a verbose manner. It
is therefore important for practitioners to use or devise forms that are
both clear and concise. The suggested introduction seeks both clarity
and precision.
