PROBATION

The Combined Probation Areas Order 1986

In exercise of the powers conferred upon me by section 54(4) of, and paragraph 1 of Schedule 3 to, the Powers of Criminal Courts Act 1973( a) and after the consultation required by that paragraph, I hereby make the following Order:--

1.--(1) This Order may be cited as the Combined Probation Areas Order 1986 and shall come into operation on 1st December 1986.

(2) This Order does not extend to Greater London.

2. The Orders specified in Schedule 1 to this Order are hereby revoked.

3. Each of the petty sessions areas specified in column 1 of Schedule 2 to this Order shall form part of the combined probation area specified opposite to that petty sessions area in column 2 of the said Schedule.

4. The probation committee for each of the said combined probation areas (hereafter in this Order referred to as "a committee") shall, subject to the provisions of paragraphs 6 and 7 of Schedule 3 to the Powers of Criminal Courts Act 1973 and section 15(3) and (4) of the Local Government Act 1985( b) (which provide for the co-option of persons by such committees) and paragraph 2(4) of Schedule 3 to the said Act of 1973 (which provides for the appointment of certain judges and justices to be members of such committees), consist of such number of justices appointed by the justices acting for each petty sessions area or, as the case may be, group of petty sessions areas from amongst their number as may be specified in column 3 of the said Schedule 2 opposite to that petty sessions area or group of petty sessions areas, as the case may be.

5. Subject to the provisions of Rule 6(2) of the Probation Rules 1984( c)(which relates to the term of office of a member of a probation committee

(a) 1973 c.62; paragraph 1 of Schedule 3 was extended by Article 3 of the Combined Probation Areas Order 1974 (S.I. 1974/529).

(c) S.I. 1984/647, to which there are amendments not relevant to this Article.

appointed to fill a vacancy), members of a committee appointed under Article 4 of this Order shall, without prejudice to any subsequent appointment, be appointed to hold office for the term of three years reckoned from 1st December next following the date on which they are appointed as aforesaid

6. The quorum of a committee shall be such number, being not less than three nor more than eight, as the committee shall from time to time determine, provided always that more than half of the number of members present shall be members appointed under Article 4 of this Order.

7. The secretary of a committee shall be--

(a) in the case of any probation area which is situated in the areas of two or more local authorities of which one or more is the council of a metropolitan district, such person appointed by the committee as it thinks fit,

(b) in the case of each of the Hampshire and North Wales probation areas, such officer of one of the councils of the counties comprised in the committee's area as may be agreed between the committee and those councils, and,

(c) in any other case, such officer of the council of the county which is coterminous with the committee's area as may be agreed between the committee and that council,

or, in default of agreement under paragraph(b) or (c) of this Article, such person as may be determined by the Secretary of State.
