The Minister of Agriculture, Fisheries and Food, the Secretary of State for Social Services and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred upon them by sections 4, 7, 118 and 119 of the Food Act 1984(a) and of all other powers enabling them in that behalf, hereby make the following regulations, after consultation in accordance with section 118(6) of the said Act with such organisations as appear to them to be representative of interests substantially affected by the said regulations:—

Title and commencement

1. These regulations may be cited as the Condensed Milk and Dried Milk (Amendment) Regulations 1986, and shall come into operation—

(a) as respects regulations 1 and 4 on 2nd February 1987, and

(b) as respects regulations 2 and 3 on 2nd February 1988.

Amendment of the Condensed Milk and Dried Milk Regulations 1977

2. The Condensed Milk and Dried Milk Regulations 1977(b) are hereby further amended—

(a) by substituting for regulations 5 and 6 thereof the following regulations:—

"Labelling and description of condensed milk and dried milk products for retail sale

5.—(1) Without prejudice to the provisions of the Food Labelling Regulations 1984(c) and subject to paragraph (2) below and regulation 6, no person shall sell by retail, or consign or deliver pursuant to a sale by retail, any condensed milk product or dried milk product

(a) 1984 c. 30.

(b) S.I. 1977/928; the relevant amending instruments are S.I. 1982/1066, 1727 and 1985/67.

(c) S.I. 1984/1305; the relevant amending instrument is S.I. 1985/67.

in a container unless that container is correctly marked or labelled with the following particulars:—

(a) a reserved description of the product, which shall be the name prescribed by law for that product for the purposes of regulation 7(1) of the Food Labelling Regulations 1984;

(b) in the case of a dried milk product which is an instant preparation containing added lecithins in accordance with paragraph (c) of the proviso to regulation 9, the word "instant" added to the reserved description;

(c) in the case of any condensed milk product containing not less than 1.0 per centum milk fat and any dried milk product containing not less than 1.5 per centum milk fat, the milk fat content or minimum milk fat content expressed as a percentage;

(d) in the case of any condensed milk product, the milk solids not fat content or minimum milk solids not fat content expressed as a percentage;

(e) in the case of any condensed milk product, directions for dilution or reconstitution, or relevant information as to usage where the product is intended...
