The claimant was a civilian employee of the police, who was dismissed for accessing pornography on the respondent’s computer equipment. In proceedings in the employment tribunal for disability discrimination, contrary to section 15 of the Equality Act 2010, the claimant relied on a doctor’s report, prepared for the internal disciplinary proceedings, which showed, the claimant said, that he was disabled by reason of depression. The report stated that “the behaviours underlying the misconduct allegations appear to reflect aberrant compulsive behaviours linked to the high levels of stress he was feeling at the time”.
