The Damages (Personal Injury) Order 2001

Made 25th June 2001

Laid before Parliament 27th June 2001

Coming into force 28th June 2001

The Lord Chancellor, in exercise of the powers conferred upon him by section 1 of the Damages Act 19961, having consulted the Government Actuary and the Treasury in accordance with section 1(4) of that Act, makes the following Order:

S-1 This Order may be cited as the Damages (Personal Injury) Order...

1. This Order may be cited as the Damages (Personal Injury) Order 2001 and shall come into force on 28th June 2001.

S-2 The rate of return referred to in section 1(1) of the Damages...

2. The rate of return referred to in section 1(1) of the Damages Act 1996 shall be 2.5 per cent.

(This note is not part of the Order)

This Order prescribes 2.5% as the rate of return which, under section 1 of the Damages Act 1996, courts are required to take into account when calculating damages for future pecuniary loss in an action for personal injury.
