Consent to a supplement to the Track Usage Price List: HTAE Vehicles
1. The Office of Rail and Road (ORR) has today issued a Notice of Consent to a
supplement to the Track Usage Price List, submitted to us jointly by Network Rail
Infrastructure Limited (Network Rail) and GB Railfreight Limited (GBRf) on 19
October 2018 under paragraph 2.2.7 of Schedule 7 of the Track Access Contract
between Network Rail and GBRf. This letter sets out the reasons for our decision.
Purpose of the change
2. The purpose of the supplement is to amend the Freight Variable Usage Charge
(VUC) rates section of the Track Usage Price List to include HTAE vehicles
conveying coal, construction material and domestic waste traffic.
Consultation
3. There is no requirement for industry consultation in this matter.
ORR review
4. The parties have told us that HTAE vehicles are not on the CP5 pricelist for coal,
construction materials and domestic waste traffic. As the new VUC has been
agreed between the parties and calculated using the agreed Control Period 5 VUC
calculator, we have not re-checked the vehicle characteristics used and are
content with the values proposed.
5. These amendments shall have retrospective effect from the first date these
vehicles were used on the Network or 1 April 2014, whichever date is later.
