Dear Iain and John,
Approval of the 38th supplemental agreement to the track access
contract between Network Rail Infrastructure Limited and Scotrail Trains
Limited dated 3 March 2016
We have today approved the above supplemental agreement submitted to us formally on
10 October 2023 under section 22 of the Railways Act 1993 (the Act). This follows an
earlier informal submission of a draft agreement for our consideration. This letter explains
the reasons for our decision.
Purpose
This supplemental agreement provides Scotrail Trains Limited with the rights necessary to
continue operation of one late evening weekday service between Edinburgh Waverley and
Dunbar. The access rights for this service are currently held by Scotrail under a 90 day
General Approval.
Industry consultation
Network Rail carried out the standard industry consultation in September and October
2023. No issues were raised by any consultees.
ORR review
Our review of the application raised no operational, performance or economic concerns.
