TERMS AND CONDITIONS OF EMPLOYMENT
The Employment Code of Practice (Picketing) Order 1992
Made 5th March 1992
Laid before Parliament 9th March 1992
Coming into force 1st May 1992
Whereas–
in pursuance of section 3 of the Employment Act 19801the Secretary of State in 1980 issued a Code of Practice on picketing (hereinafter called “the 1980 Code”);
under section 3(6) of the said Act the Secretary of State may from time to time revise the whole or any part of a Code of Practice issued under section 3 of the said Act and sub-sections (2) to (5) of that section apply to such a revised Code as they apply to the first issue of a Code;
in pursuance of section 3(6) of the said Act the Secretary of State determined to revise the whole of the 1980 Code;
in pursuance of section 3(2) of the said Act the Secretary of State, after consultation with the Advisory, Conciliation and Arbitration Service, prepared and published in draft a revised Code of Practice on picketing;
in pursuance of section 3(3) of the said Act the Secretary of State considered representations made to him about the draft;
in pursuance of section 3(4) of the said Act the Secretary of State laid the draft of the revised Code of Practice before both Houses of Parliament, the draft was approved by resolution of each House of Parliament and the Secretary of State is issuing the said Code of Practice in the form of the draft;
Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 3(5) of the said Act, hereby makes the following Order:–
Citation and commencement
1. This Order may be cited as the Employment Code of Practice (Picketing)Order 1992 and comes into force on 1st May 1992.
Appointed day for revised Code of Practice
2. The day appointed for the coming into operation of the revised Code of Practice on picketing issued by the Secretary of State pursuant to section 3(4) and (6) of the Employment Act 1980 is 1st May 1992.
