Interpretation

1.—(1) In these rules, unless the context otherwise requires—

(a) "Education authority" and "education area" have the meanings assigned to them by subsection (1) of section 143 of the Education (Scotland) Act, 1946;

(b) "Entertainment" includes a rehearsal for an entertainment;

(c) "Parent" includes guardian and any person who is liable to maintain or has the actual custody of the child;

(d) "Performance" includes a rehearsal for a performance.

(2) The Interpretation Act, 1889, applies to the interpretation of these rules as it applies to the interpretation of an Act of Parliament.

Application for a licence.

2. An application for a licence to enable a child to take part in an entertainment or a series of entertainments shall be made to the education authority of the area in which the parent of the child is ordinarily resident and shall be in writing, signed by the parent and the prospective employer of the child, in the form contained in the First Schedule hereto, and shall be accompanied by the documents mentioned in that Schedule.

Form of licence.

3.—(1) If a licence is granted by the education authority, it shall be as nearly as may be in the form and subject to the conditions and restrictions specified in the Second Schedule annexed hereto, provided that so much of paragraphs 7, 8 and 9 of the licence as are inapplicable shall be deleted.

(2) One print of the photograph of the child submitted with the application for the licence shall be attached to the licence.

(3) Subject to the provisions of Rule 5 of these rules, no licence shall be granted for a period exceeding six months.

(4) In the case of a child who has reached the date fixed by the education authority under section 33 of the Education (Scotland) Act, 1946, for terminating school attendance next following his fourteenth birthday, the hour to be inserted in paragraph 1 of the licence as the hour not later than which the child must leave the place of entertainment may be an hour not later than 10 p.m., provided that if the education authority are satisfied that the retention of the child up to a later hour is necessary for the performance they may insert an hour not later than 11 p.m.

Information to be furnished before entertainment.

4. The holder of a licence shall, at least seven days before the child takes part in any entertainment, furnish to the education authority within whose area the entertainment is to take place the information indicated in the Third Schedule hereto.

Variation and extension of licence.

5. A request to an education authority for a variation or extension of a licence shall be made in writing and shall state the grounds on which a variation or extension is desired. No variation or extension of a licence shall be made which renders the licence inconsistent with the provisions contained in these rules as to restrictions or conditions subject to which a licence may be granted.

Citation, commencement and revocation.

6.—(1) These rules may be cited as the Employment of Children in Entertainments (Scotland) Rules, 1947.

(2) These rules shall come into operation on 1st October, 1947, and the Employment of Children in Entertainments (Scotland) Rules, 1939(a), are hereby revoked as from that date, provided that applications or licences made or granted before the said date under the rules

hereby repealed shall have the like effect as if they had been made or granted under these rules.

PART I.

Notes for the Information of the Applicants.

1. It is illegal for a child under the age of thirteen years to take part in any entertainment in connection with which a charge is made to the audience.

2. It is illegal for a child between his thirteenth birthday and the fixed date for terminating school attendance next following his fifteenth birthday to take part in any entertainment...
