Dear Stakeholder,
Extension to deadline in Review Initiation Notice pursuant to Schedule 4A of
the Railways Act 1993
On 9 June 2022, we gave formal notice of our intention to undertake an access
charges review by way of serving two notices issued under Paragraph 1C of
Schedule 4A to the Railways Act 1993.
This access charges review, which we refer to as the 2023 periodic review (or
PR23), will determine what Network Rail is expected to deliver with respect to its
infrastructure operations and the level of funding that it is provided with over the five-
year period from 1 April 2024 (known as control period 7 (or CP7)).
As you are aware, the High-Level Output Specification (HLOS) document will set out
what the respective funders’ objectives are and what they want the railway to deliver
over CP7. The Statement of Funds Available (SoFA) sets out the level of funding
each funder will make available to deliver the corresponding HLOS.
The previous information and the notices we issued are available on our website and
can be accessed at: www.orr.gov.uk/pr23-legal-notices
We served notices to each funder as follows:
The notice to the Secretary of State required the HLOS and SoFA documents
for England and Wales by 28 October 2022; and
The notice to Scottish Ministers required their HLOS and SoFA documents by
30 November 2022.
In light of changing circumstances, we recognise the Secretary of State and the
Scottish Ministers will require more time to provide their respective High-Level
Output Statement (HLOS) and their Statement of Funds Available (SoFA). Therefore,
we are issuing an extension to the Review Initiation Notice and now require that:
the Secretary of State provides us with the HLOS and SoFA documents for
England & Wales by 25 November 2022; and
Scottish Ministers provide us with their HLOS and SoFA documents by 9
January 2023.
This will enable us to complete our periodic review by the statutory deadlines,
including to ensure appropriate funding is in place for Network Rail for CP7.
