The Family Income Supplements (Computation) Regulations 1985

The Secretary of State for Social Services, in exercise of the powers conferred on him by sections 2(1), 3(1) and (1A) and 10(3A) of the Family Income Supplements Act 1970(a), and of all other powers enabling him in that behalf, hereby makes the following regulations of which a draft has, in accordance with section 10(5) of that Act, been laid before Parliament and approved by resolution of each House of Parliament:—

Citation and commencement

1. These regulations may be cited as the Family Income Supplements (Computation) Regulations 1985 and shall come into operation on 26th November 1985.

Prescribed amount

2.—(1) The prescribed amount for any family for the purposes of section 1(2) of the Family Income Supplements Act 1970 shall be the amount specified in paragraph (2) or (3) below as the case may be.

(2) Where the family includes only one child, the prescribed amount shall be—

(a) £97.50, if the child is aged under 11; or

(b) £98.50, if the child is aged under 16 but not less than 11; or

(c) £99.50, if the child is aged 16 or over.

(3) Where the family includes more than one child, the prescribed amount

(a) 1970 c. 55; section 2(1) was amended by paragraph 3 of Schedule 4 to the Child Benefit Act 1975 (c. 61) and section 3 was amended by paragraph 4 of that Schedule; section 10(3A) was inserted by section 7(5)(b) of the Social Security Act 1980 (c. 30), which applies section 166(2) and (3) of the Social Security Act 1975 (c. 14).

shall be the aggregate of whatever would be applicable under paragraph (2) above if the first child were the only child plus, for each additional child—

(a) aged under 11, £11.50;

(b) aged under 16 but not less than 11, £12.50;

(c) aged 16 and above, £13.50.

Maximum amount of family income supplement

3.—(1) The weekly rate of family income supplement shall not exceed the amount specified in paragraph (2) or (3) below as the case may be.

(2) Where the family includes only one child, the weekly rate of family income supplement shall not exceed—

(a) £25, if the child is aged under 11; or

(b) £25.50, if the child is aged under 16 but not less than 11; or

(c) £26, if the child is aged 16 or over.

(3) Where the family includes more than one child, the weekly rate of family income supplement shall not exceed the aggregate of whatever would be applicable under paragraph (2) above, if the...
