The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred upon Her by paragraph 4(5) of Schedule 1 to the Films Act 1985, is pleased, by and with the advice of Her Privy Council, to provide, and it is hereby provided, as follows:—

S-1 This Order may be cited as the Films Co-Production Agreements...

1. This Order may be cited as the Films Co-Production Agreements Order 1985 and shall come into operation on 22nd July 1985.

S-2 A film with respect to which the requirements of Schedule 1 to...

2. A film with respect to which the requirements of Schedule 1 to the Films Act 1985 as to the eligibility of a film for certification as a British film are not fulfilled shall be treated as a film with respect to which those requirements are fulfilled if the film was made in accordance with the respective agreements made between the Government of the United Kingdom and the Governments of the countries set out in the Schedule to this Order.

EXPLANATORY NOTE

This Order provides that films made in accordance with agreements made between the Government of the United Kingdom and the Governments of the countries listed in the Schedule to the Order are to be entitled to the full enjoyment of all the benefits which are or may be accorded in Great Britain to national films. Thus such films are to be treated as British films for the purposes of eligibility for certification as films on which expenditure on production or acquisition shall be regarded as expenditure of a revenue nature. The agreements with France, Italy, the Federal Republic of Germany, Canada and Norway are published as Cmnd. 2781, 3434, 5972, 6274 and 8860 respectively. The agreements relate to films which may be made by a British producer in co-operation with a producer from one of the respective countries in accordance with the terms of an approval given by the competent authorities designated by the respective Governments.
