The Firemen's Pension Scheme Order, 1958

In exercise of the powers conferred on me by section twenty-six of the Fire Services Act, 1947(a), I hereby with the approval of the Treasury and after consultation with the Central Fire Brigades Advisory Council and the

(a) 10 & 11 Geo. 6. c. 41.

Scottish Central Fire Brigades Advisory Council, make the following Order:—

1.—(1) In Article 19 of the Firemen's Pension Scheme, 1956, set out in the Appendix to the Firemen's Pension Scheme Order, 1956(a), (which relates to the duration of a child's allowance) after the words "A child's allowance" there shall be inserted the words "granted before the fourteenth day of March, 1958".

(2) At the end of the said Article there shall be added the following paragraph:—

"(2) A child's allowance granted on or after the fourteenth day of March, 1958, shall only be payable if and so long as the child has not attained the age of sixteen years or if and so long as he has not attained the age of eighteen years and either is undergoing full-time instruction in a school or is an apprentice.".

2. At the end of Article 23 of the said Scheme of 1956 (which relates to the allocation of pensions) there shall be added the following paragraph:—

"(12) In the case of a chief officer or in Scotland a firemaster, in determining for the purposes of this Article—

(a) whether he is entitled to retire with an ordinary pension; or

(b) where he dies before retiring, the pension which would have been paid if he had retired immediately before he died,

no account shall be taken of the restriction on entitlement to an ordinary pension contained in paragraph (2) of Article 1 of this Scheme.".

3. In sub-paragraph (5) of paragraph 1 of the Seventh Schedule to the said Scheme of 1956 (which relates to the calculation of transfer values) after the words "by the authority" there shall be added the words "any retrospective increase therein granted after that time being ignored".

4. This Order may be cited as the Firemen's Pension Scheme Order, 1958, and shall come into operation on the fourteenth day of March, 1958.
