The Firemen's Pension Scheme Order, 1950

In exercise of the powers conferred on me by section twenty-six of the Fire Services Act, 1947(a), and of all other powers enabling me in that behalf, I hereby, with the approval of the Treasury and after consultation with the Central Fire Brigades Advisory Council and the Scottish Central Fire Brigades Advisory Council, make the following Order:—

1. For Article 42 of the Firemen's Pension Scheme, 1948, set out in the Appendix to the Firemen's Pension Scheme Order, 1948(b), there shall be substituted the following Article:—

"42.—(1) Every fire authority shall maintain a separate account showing all sums received by the authority under this Scheme, including all such sums as were held in a fund immediately before the thirty-first day of March, 1950, and showing all sums paid by the authority under or for the purposes of this Scheme.

(2) Where in any year the receipts credited to the account mentioned in paragraph (1) of this Article exceed the payments debited thereto, the balance may be transferred to a pension reserve account.

(3) Where in any year the payments debited to the account mentioned in paragraph (1) of this Article exceed the receipts credited thereto, the balance shall be met out of the pension reserve account to the extent thereof.

(4) In this Article the expression 'year' means, in relation to England, a year beginning on the first day of April and ending on the following thirty-first day of March, and in relation to Scotland, a year beginning on the sixteenth day of May and ending on the following fifteenth day of May."

2. This Order may be cited as the Firemen's Pension Scheme Order, 1950, and shall come into operation on the thirty-first day of March, 1950.
