The Football (Disorder) (Duration of Powers) Order 2001

Coming into force 28th August 2001

Whereas section 5(2) of the Football (Disorder) Act 20001provides that, subject to section 5(4) of that Act, no application under section 14B of the Football Spectators Act 19892may be made, and no power conferred on a constable by section 21A or 21B of that Act3may be exercised, after the end of the initial period4;

And whereas a report about the working of the Football (Disorder) Act 2000 has been laid before each House of Parliament in accordance with section 5(5) of that Act;

And whereas a draft of this Order has been laid before and approved by a resolution of each House of Parliament:

Now, therefore, the Secretary of State, in exercise of the powers conferred upon him by section 5(4) of the Football (Disorder) Act 2000, hereby makes the following Order:

1. This Order may be cited as the Football (Disorder) (Duration of Powers) Order 2001 and shall come into force on 28th August 2001.

S-2 Continuation of powers beyond initial period

Continuation of powers beyond initial period

2. Applications under section 14B of the Football Spectators Act 1989 (banning orders made on a complaint) may be made, and the powers conferred on a constable by sections 21A and 21B of that Act (summary measures) may be exercised, during the period of one year from 28th August 2001.

The Football (Disorder) Act 2000 amended the Football Spectators Act 1989 by, inter alia, adding sections 14B, 21A and 21B.

Section 14B provides a procedure for the imposition of football banning orders after an application by complaint, i.e. by way of a civil procedure.

Section 21A provides power in some circumstances for the police to detain persons with a view to deciding whether to issue a notice under section 21B. Section 21B provides for the issue of a notice requiring attendance at a magistrates' court for consideration of the making of a banning order and prohibiting the leaving of England and Wales in the meantime. That section also contains power to order the surrender of the passport of the person concerned.
