In exercise of the powers conferred upon me by section 1(2) of the Football Spectators Act 19891, I hereby make the following Order:

S-1 This Order may be cited as the Football Spectators (Designation...

1. This Order may be cited as the Football Spectators (Designation of Football Matches in England and Wales) Order 1990 and shall come into force on 24th April 1990.

S-2 Football matches of the description specified in paragraph (2)...

2.—(1) Football matches of the description specified in paragraph (2) below are hereby designated for the purposes of Part I of the Football Spectators Act 1989.

(2) The football matches to which paragraph (1) above applies are any association football match (played in England or Wales) being a match which—

(a)

(a) either forms part of a competition organised by or on behalf of the Union des Associations Europeennes de Football (U.E.F.A.) or involves a team which represents—

(i) a club which is, at the time the match is played, a member (whether a full or associate member) of the Football League, or

(ii) a country or territory, or

(iii) a club in a country or territory outside England and Wales, and

(b)

(b) is played at a sports ground which is, at the time the match is played, either designated by order under section 1(1) of the Safety of Sports Grounds Act 19752or occupied by a club to which the description in sub-paragraph (a)(i) above applies.

This Order designates association football matches falling within the description set out in article 2(2) for the purposes of Part I of the Football Spectators Act 1989 (“the 1989 Act”). Under section 1(1) of that Act, Part I applies to designated football matches played in England and Wales.

By virtue of section 14(6) of the 1989 Act, which is contained in Part II of that Act, the designation of matches for the purposes of Part I also has effect for the purposes of Part II. Under section 14(5), the offences which are “relevant” for the purposes of the making by a court of a restriction order (under section 15) are those specified in Schedule 1 to that Act as relevant offences.
