An Act to confirm a Provisional Order under the Private
Legislation Procedure (Scotland) Act 1936, relating to
Glasgow Corporation Consolidation (Water, Transport
and Markets). [23rd December 1964]

HEREAS
the
Provisional Order
set
forth
in the
schedule
hereunto annexed
has
been made
by the
Secretary
of
State under
the
provisions
of the
Private Legislation
Procedure (Scotland)
Act,
1936,
and it is
requisite that
the
said
1936
c.
52.
Order should
be
confirmed
by
Parliament:
Be
it
therefore enacted
by
the Queen's most Excellent Majesty,
by
and
with
the
advice
and
consent
of the
Lords Spiritual
and
Temporal,
and
Commons,
in
this present Parliament assembled,
and by the authority
of
the same, as follows:—

The
Provisional Order contained
in the
schedule hereunto Confirmation
annexed
is
hereby confirmed. of
Order
in
schedule.
2.
This
Act may be
cited
as the

SCHEDULE
GLASGOW CORPORATION CONSOLIDATION
(WATER, TRANSPORT AND MARKETS)
Provisional Order
to
consolidate with amendments
the Acts and
Orders
of
or relating
to the
water,
transport,
markets and
slaughterhouses
undertakings
of
the Corporation
of
the
city of
Glasgow,
to
confer
further
powers
on them with
respect
to such
undertakings
and for
other
purposes.
Whereas the lord provost, magistrates and town councillors of the
city and royal burgh of Glasgow (hereinafter called " the Corporation ")
are vested with the municipal government and administration of the
city and royal burgh of Glasgow (hereinafter called " the city ") and
are the local authority therein:
And whereas the Corporation are the owners of and are vested in
the water, transport and markets and slaughterhouses undertakings
of the city and are the local water authority within the city and certain
adjoining areas:
And whereas the Acts and Orders relating to the said undertakings
are very numerous and in many cases have been superseded by subse-
quent legislation and ought to be repealed and it would be of public
and local advantage if such of the provisions of the said
Acts
and Orders
as it is expedient to retain were consolidated with certain additions
and amendments:
And whereas it is expedient that the further provisions contained
in this Order should be enacted:
And whereas in the month of
March,
1964,
a map marked " Glasgow
Corporation Water Supply Limits Map" showing the area within
which the Corporation are the local water authority and are supplying
water (hereinafter referred to as the limits of the Corporation for
the supply of water) was deposited with the town clerk and copies of
the said map were in the same month deposited with the clerks to the
Eighth and Ninth District Councils of the county of Lanark, the
clerks to the

District Council of the
county of Renfrew, the clerk to the Western No. 3 District Council
of the county of Stirling and
the
town
clerks
of
the burghs
of Rutherglen,
Barrhead, Renfrew, Milngavie and Bearsden respectively:
And whereas the purposes aforesaid cannot be effected without an
Order confirmed by Parliament under the Private Legislation Procedure
1936

Now therefore in pursuance of the powers contained in the last-
mentioned Act the Secretary of State orders as follows:—
PART I
PRELIMINARY
1.
This Order may be cited as the Glasgow Corporation Consolida- Short
title
and
tion (Water, Transport and Markets) Order 1964. citation.
2.-AX) Words and expressions to which meanings are assigned by Interpretation.
the city Acts or by any public Act applicable to the Corporation or
wholly or partially incorporated with this Order shall, subject to the
provisions of this Order and unless there is something in the subject
or context inconsistent with or repugnant to such construction, have
the same respective meanings in the provisions of this Order in which
such words and expressions are used.
(2) The following words and expressions in this Order have, unless
there is something in the subject or context repugnant to such
construction, the meanings hereby assigned to them, that is to say:—
" Act of 1947 " means the Local Government (Scotland) Act,
1947;

" city " means the city and royal burgh of Glasgow;
" city Acts " means the local Acts and Orders applicable to the
city;
" common good " means the common good of the city;
" Corporation " means the Corporation of the city of Glasgow;
" existing " means existing immediately before the date of the
passing of the Act confirming this Order (hereinafter referred
to as " the commencement of this Order ");
" Lands Clauses Acts " means the Lands Clauses Acts as modified
by the Acquisition of Land (Assessment of Compensation)
Act, 1919;

" Loans Acts " means the Glasgow Loans Acts, 1883 to 1953;
" markets undertaking " means the markets undertaking of the
Corporation as defined in section 109 (Definitions for Part IV
of Order) of this Order;
"operational land" in relation to any statutory undertakers,
means land of those undertakers which is operational land
within the meaning of the Town and Country Planning
(Scotland) Act, 1947;

" repealed Acts " means the provisions of the Acts and Orders
specified in Schedule 8 to this Order and repealed by this
Order;

town clerk " means the town clerk of the city;
