Grand Union Trains No. 2 Limited Conditions Precedent
Thank you for your email of 29 November 2024 providing evidence in respect of the
condition precedent set out in clause 3.8 of the Grand Union Trains No. 2 Limited (Grand
Union) track access contract dated 13 June 2023 (the Contract) relating to rolling stock
procurement.
Clause 3.8 of the Contract requires Grand Union to provide ORR with evidence that it has
entered into a contract scheduled to expire on or after the Expiry Date, to procure a
minimum of four new-build trains each with:
(i) at least bi-mode power traction;
(ii) capability to operate at 125mph on the Great Western Main Line, including
installation of Automatic Train Protection (ATP); and
(iii) capability to meet the Sectional Running Times (SRTs) for Class 80x rolling stock,
including electric power traction where electrification is available, as proven by
either of:
observed data from test runs under conditions agreed between Network Rail
and the Train Operator;
modelling which passes Network Rail quality assurance.
We are satisfied that the evidence provided by Grand Union on 29 November 2024 meets
these conditions. This letter should be taken as ORR’s written confirmation for the
