The Greater London Magistrates' Courts Authority (Pensions) Order 2002

The Lord Chancellor, in exercise of the powers conferred upon him by section 50 of the Justices of the Peace Act 19971and paragraph 36 of Schedule 14 to the Access to Justice Act 19992, with the consent of the Minister for the Civil Service, makes the following Order:

S-1 This Order may be cited as the Greater London Magistrates'...

1.—(1) This Order may be cited as the Greater London Magistrates' Courts Authority (Pensions) Order 2002 and shall come into force on 13th September 2002.

(2) In this Order—

“the Authority” means the Greater London Magistrates' Courts Authority referred to in section 30A(1) of the Justices of the Peace Act 19973;

“the Act” means the Superannuation Act 19724; and

“inner London court staff” has the meaning given by paragraph 36(11) of Schedule 14 to the Access to Justice Act 1999.

S-2 Section 1 of the Act applies to persons employed by the...

2.—(1) Section 1 of the Act applies to persons employed by the Authority.

(2) Accordingly, Schedule 1 to the Act is amended by inserting, at the appropriate place in the list of “Other Bodies”, the entry “The Greater London Magistrates' Courts Authority”.

(3) Section 1 of the Act also applies to persons who do not fall within paragraph (1) but who—

(a)

(a) have been members of the inner London court staff, and

(b)

(b) immediately before this Order comes into force are entitled to a present or future pension or benefits by virtue of section 15 of the Superannuation (Miscellaneous Provisions) Act 19675.

S-3 The Authority shall pay to the Minister for the Civil Service,...

3. The Authority shall pay to the Minister for the Civil Service, at such times as he may direct, such sums as he may determine in respect of the increase attributable as a result of this Order in the sums payable under the Act out of money provided by Parliament.
