The Hill Farming Improvements (Settled Land) (Northern Ireland) Regulations, 1949

In pursuance of subsection (5) of Section 40 of the Hill Farming Act, 1946(c), the Minister of Agriculture and Fisheries hereby makes the following Regulations:—

1. These Regulations, which may be cited as the Hill Farming Improvements (Settled Land) (Northern Ireland) Regulations, 1949, apply to Northern Ireland and shall come into operation on the 28th day of November, 1949.

2. The Interpretation Act, 1889(a), as applied to Northern Ireland by the Interpretation Act, 1921(b), applies to the interpretation of these Regulations as it applies to the interpretation of an Act of Parliament.

3. Any operation set out in the Schedule hereto which is treated as an improvement for the purpose of the Hill Farming Act, 1946, shall be treated for the purposes of the provisions of the Settled Land Act, 1882(c), as amended by any subsequent enactment, as if it were an improvement of a permanent character enumerated in Section 25 of the Settled Land Act, 1882, (which specifies improvements on which capital trust money may be expended).

SCHEDULE

1. Execution of works for or in connection with the supply of electricity for agricultural or domestic purposes.

2. Provision of permanent accommodation for the treatment of sheep or cattle.

3. Provision of permanent pens and other permanent equipment for use for or in connection with the sheltering, gathering, marking, or treatment of sheep or cattle.

4. Formation of silos.

5. Restoration or removal of permanent fences.

6. Provision of grids designed or adapted to prevent the passage of sheep or cattle.

7. Establishment of shelter belts.

8. Removal of bracken, whins, gorse, bushes, scrub, stumps, roots or boulders.
