ANNO SEXTO G Cap. x. An Act for repairing the Road from Hnckley, in the County of Leicester, to Nuneaton, in the County of Warwick, and from thence to Bishop's Gate, in the City of Coventry. [23d March 1825.1 HEREAS an Act was passed in the Twenty-seventh Year of the Reign of His late Majesty King George the Second, intituled An Act for repairing and widening the Road from 27G.2. c.42. Leicester to Narborough, and from Leicester to Coventry, and from thence through Kenilworth to Warwick, and from thence to Halford Bridge, and from Warwick to Stratford-upon- Avon, andfrom Coventry to Martyn's Gutter, leading towards Stoneleigh Town ; and for Sup plying an Omission in an Act passed in dhe last Session of Parliament, for repairing the Road from Leicester to Ashby-de-la-Zouch, in the County cf Leicester: And whereas another Act was passed in the Twenty-ninth Year of the Reign of His said late Majesty, intituled An Act for explaining, amending, and rendering more efectual, an Act 29 G. 2. c. 66- passed in the Twenty-seventh Year qf His present Mdjesty, for repair- ing and widening the Road from Leicester to Narborough, and from Leicester to Coventry, and from thence through Kenilworth to War- wick, and from thence to Halford Bridge, and from Warwick to Strat- ford-upon-Avon, and from Coventry to Martyn's Gutter, Zeading towards Stoneleigh Town ; and for supp7lying an Omission in an Act passed in the last Session of Parliament, for repairing the Road from [Local.] 3Q Leicester 246 6" GEORGII IV. Leicester lo Ashby-dela-Zouch, in the County ofleicester, SO far as the same relates to that Part of the said Road which leads from the , to the Town of Nun- Chilvers, Coton, and k, as relates to the Road between Hinckley and Coventry: And whereas another Act was passed in the Forty-fifth Year of the Reign of His said late Ma- 45 G. 3. c.50. jesty King George the Third, intituled An Act to revive, continue, and enlarge the Term and Powers of Three Acts passed in the Twenty- seventh and Twenty-ninth Years of His late Mnjesty, and in the Second Year of His present Majesty, for repairing ihe Roads therein men- tioned, so far as thesaid Acts relate to the Road leading from the Town of Hinckley, in the County of Leicester, to the Tow of Nuneaton, in the County of Warwick, and from thence to Bishop's Gate, in the City Of Coventry: And whereas the Trustees appointed in or by virtue of the said recited Acts for the Care of the said Road leading from the Town of HinckZey to Nuneaton, and from thence to Bishop's Gate, in the City of Coventry, have proceeded in the Execution thereof, and have from Time to Time for that Purpose borrowed several consider- able Sums of Money on the Credit of the Tolls authorized to be taken on the said last-mentioned Road, which Money still remains due and owing, and the same cannot be repaid, nor can the said last-mentioned Road be ef3ectually amended and kept in repair unless the Terms and eIiowers of the said Acts, so far as the same respectively relate to the said last-wentioned Road, are enlarged, and the Tolls increased : eas an Act was passed in the Third Year of the Reign of t Majesty, intituled An Act to amend the General Laws now in being for regulating Roads in that Part of Great Britain alled England : And another Act was passed in the Fourth 4 G. 4. C. 95. Gear of the Reign of His present Majesty, intituled An Act to explain and amend an Act passed in the Third Year of the Reign of His pre- sent Majesty, to amend the General Laws NOW in being for regulating ?'urnpike Roads in that Part of Great Britain called England : And whereas another Act was passed in the Fifth Year of the Reign of His 5 G. 4. e. 69. present Majesty, intituied An Act to enable Justices of the Peace for Ridings, Divisions, or Sokes, to act as Trustees for repairing and main- taining Turnpilce Roads : And whereas it would facilitate the Execu- .tion of the Purposes aforesaid if the said Four first recited Acts, so far as the same relate to the said Road leading from Hinckley to Nun- eaton, and from thence to Bishop's Gate, in the City of Coventry, were repealed, and if further and other Powers and Provisions were granted instead thereof: May it therefore please Your Majesty that it may be enacted ; and be it enacted by the King's most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Tem- poral, and Commons, in this present Parliament assembled, and by On 22d Sept. the Authority of the same, That upon the Twenty-second Day of Sep- 1823, tile re- teaber next after the passing ofthis Act, the said recited Acts passed 29 G, 2, in the 'rwenty-seventh and Twenty-ninth Years of the Reign of His 2 said cited Acts 27 6" 'GE ORGII rv. 2-47 said late Majesty King George the Second, and in the Second and asalsothe Forty-fifth Years of the Reign of His said late Majesty King George so far as re- the Third, so far as the same relate to the said Road leading from the late to the Town of Hinckley, in the County of Lekester, to the Town of Nun- Road herein eaton, in the County of Warwick, and from thence to Bishop's Gate described, shall be re- in the City of Coventry, shall be and the same are hereby respectively pealed, and declared to be repealed ; and instead thereof, this Act shall be put in this Execution for and during the Term herein-after mentioned, for the take Effect. Purpose of more effectually amending, widening, improving, and keeping in repair the present Turnpike Road leading from the Town of Hinckley, in the County of Leicester, to the Town of Nuneaton, in the County of Warwick, and from thence to Bishop's Gate, in the City of Coventry, and which said District of Road passes through or into the several Parishes or Townships of Hinckley, in the County of Leicester, Nuneaton, Chihers, Coton, Grg and Bedworth, in the County of Warwick, and Exhall, Foleshill, and the Hob T~nity, in the County of the City of Coventry ; and this Act and the Term and Tolls hereby granted shall be, and the same are hereby made subject and liable to the Payment of all Monies heretofore borrowed for making, repairing, and maintaining such Road, and now due and owing upon the Credit or on Account of the said former Acts respectively, or secured upon or made payable out of the Tolls thereby authorized to be taken upon the said Road, and of all Interest due and to grow due thereon, as fully and effectually, to all Intents and Purposes, as if such Monies had been borrowed and become due on the Credit of'this Act, or of the Tolls hereby authorized to be collected. in the Third Year of the Reign of His present Majesty, and all and every the Powers, Provisions, Exemptions, Penalties, Forfeitures, 5 G. 4. to Payments, Remedies, Matters, and Things therein contained (save extend to and except such Parts thereof as are expressly varied, altered, or this*ct* repealed by the said recited Act passed in the Fourth Year of the Reign of His present Majesty, or varied, altered, or otherwise pro- vided for by this Act), and also the said recited Act passed in the Fourth Year of the Reign of His present Majesty, and all and every the Powers, Provisions, Exemptions, Penalties, Forfeitures, Payments, Remedies, Matters, and Things therein contained (save and except such Parts thereof a3 are expressly varied, altered, or otherwise PO- vided for by this Act), and also the said recited Act passed in the Fifth Year of the Reign of His present Majesty, shall respectively be as good, valid, and effectual for carrying this Act into Execution as if the same had been repeated and re-enacted in the Body of this Act. 2 and 45 (3.3, 11. And be it further enacted, That the said recited Act passed The P~wers 111. And be it further enacted, That all Arrears of Tolls or Rents Former or other Monies due to, and Property Real or Personal, and all Choses in and Rights of Action, either at Law or in Equity, vested in Trustees, the said Trustees under the said Four first recited Acts, or any of them, shall immediately on the Commencement of this Act be vested in the Trustees for executing this Act, who shall be and are hereby enabled to sue for and recover the same, and for that Purpose to cause to be commenced and prosecuted all Actions and Suits at Law and in Debts, &c. vested in new Former Books to be Evidence, and Mort- gages, &c. under old Acts to be valid. Where old Securities are lost,new ones may be exe- cuted. 6" GEORGII IV. Cap. x. in Equity, and to act in respect thereof as effectually as if the Same had become due to or had been vested in them under and by virtue of this Act ; or such Arrears of Tolls or Rents or other Monies so due to the said Trustees under such Acts, or any of them, by virtue of any Deed or Specialty, shall and may be sued for and recovered in the Name or Names of the Trustee or Trustees to or with whom such Deed or Specialty shall have been so made or entered into, at the Option or Election of the Trustees for executing this Act; and all the Costs to be incurred by the Trustees or Persons in whose Names such Proceedings shall be hzd, shall be paid and defrayed by and out of the Monies to be-received by virtue of this Act, and the Monies when recovered shall be paid over to the Treasurer or Treasurers of the said Trustees, to be agplied for the Purposes of this Act. IV. And be it further enacted, That all and every the Books and Book of Proceedings which may have been kept by the Trustees acting in the Execution of the Acts hereby repealed, or by their Treasurer or Clerk under their Direction, according to the Provi- sions of such Acts, and also the Book or Books to be kept for the Purposes of this Act, shall be admitted as Evidence in all Courts, and by all Judges...
