The Import and Export of Trees, Wood and Bark(Health) (Great Britain) (Amendment) Order 19866thFebruary 1986

The Forestry Commissioners, in exercise of the powers conferred on them by sections 2 and 3(1) and (2) of the Plant Health Act 1967(a), and of every other power enabling them in that behalf, hereby make the following order:—
Title, extent and commencement
1. This order may be cited as the Import and Export of Trees, Wood and Bark (Health) (Great Britain) (Amendment) Order 1986, shall apply to Great Britain and shall come into operation on 10th March 1986.
Amendment of principal order
2. The Import and Export of Trees, Wood and Bark (Health) (Great Britain) Order 1980(b) is further amended as follows:—
(1) The following are omitted:—
(a) in Article 2(1) (interpretation) the definition of "non-indigenous tree pest";
(b) Article 4(b) (prohibition of the landing of certain non-indigenous tree pests); and
(c) Article 14(1)(b) and (c) (action in relation to the landing of trees, wood, isolated bark and soil carrying certain tree pests).
(2) For sub-paragraphs (b) and (c) of paragraph (2) of Article 14 there is substituted the following sub-paragraph:—
"(b) such tree, wood, isolated bark or soil is carrying or infected with any tree pest which is not normally present in Great Britain and in respect of which there is in the opinion of the inspector an imminent danger of its spreading or being spread in Great Britain;".
(a) 1967 c.8; sections 2(1), 3(1) and (2) were amended by the European Communities Act 1972 (c.68), section 4(1) and Schedule 4, paragraph 8.
(b) S.I. 1980/449; the relevant amending instrument is S.I. 1983/807.
