This volume is the result of a research project conducted by the European Group on Tort Law. That does not mean that its focus is confined to Europe: there are contributions on South Africa and the United States, as well as the European Union. Apart from these, however, all the jurisdictions are European (including in that term England and Wales). Scotland is not covered.
The book is, in a sense, back to front. Part I is entitled “Theoretical and Comparative Analyses”. It draws together the threads of the reports on the law of various jurisdictions set out in Part II. Those reports in turn respond to a series of questions set out in an Appendix. The questions take the form of case studies; each national report explains how the issues of prescription arising would be handled in its jurisdiction. Some reports raise wider issues.
The reports in Part II will be a useful resource for the comparative lawyer. The case studies cover all the key elements: when prescription starts; for how long it runs; whether it can be extended; and whether there is a final cut-off, as well as points of finer detail.
