As the introduction to this book observes, much of contemporary Scots family law is of recent origin. Even in the years since the publication of the last edition of the book, there have been significant developments, both in case law and via the introduction of new or updated legislation. This book therefore provides a much-needed update to the late Joe Thomson’s formative text, which has served as an invaluable source of knowledge and reference for students and professionals in Scotland since the publication of the first edition in 1987. Macfarlane provides a clear yet thorough account of these developments across fifteen chapters, which span a range of topics from the formalities of marriage and civil partnership, to children’s legal capacity and rights, to the children’s hearings system. Although Macfarlane provides a meticulous account of legal developments, it is pleasing to see that Joe Thomson’s voice and perspectives are still very much part of this text. At various points Macfarlane refers to Thomson’s views on issues such as the grounds for divorce, financial provision principles and parental rights and responsibilities.
