COURTS OF KINGS BENCH
BAYER. 101. TRINITY TERM, 27 GEO. II. 1753 817 lawrence vers. boswell. A verdict for the finding of which the jurors voted ought not to be set aside. Upon a rule to shew cause, why a new trial should not be had, it appeared; that the jurors, not agreeing as to the finding of a verdict, voted for one; that the votes of seven of them were for finding it as it is found ; and that no objection was made by the other five when the verdict was given. The rule was discharged. And by the Court-Nothing was in this case determined by chance.
